These Terms of Service ("Terms") govern your access to and use of the Profita platform and services provided by Grova Technology (HK) Limited ("we", "us", or "Profita"). By accessing or using Profita, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using any part of the Profita platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not access or use the platform.
2. Description of Service
Profita is a full-chain ROI engine designed for solopreneurs and advertising professionals. Our platform provides: • Creative & Asset Engine: AI-powered ad creative generation, multi-format cropping, and localized voiceover. • Omni-Channel Distribution Hub: Cross-platform ad campaign management, smart bidding, and fraud filtering. • Data & Attribution Infrastructure: MMP integration, event mapping, SKAN automation, and multi-currency/timezone alignment. • Monetization Optimization: Aggregated SDK integration, waterfall optimization, and bidding conflict resolution. • User Segmentation: Dynamic pricing, user tagging, and personalized ad frequency control.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account and keep it up to date. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to: • Use the platform for any illegal or unauthorized purpose. • Attempt to gain unauthorized access to any part of the platform or its systems. • Interfere with or disrupt the platform or servers connected to it. • Upload malicious code, viruses, or harmful content. • Use the platform to distribute misleading or fraudulent advertising. • Resell, sublicense, or redistribute access to the platform without our written consent.
5. Intellectual Property
All content, features, and functionality of the Profita platform — including software, algorithms, designs, text, graphics, and trademarks — are owned by Grova Technology (HK) Limited and are protected by intellectual property laws. You retain ownership of data you upload to the platform.
6. Payments and Billing
Certain features of Profita require a paid subscription. Pricing is customized based on your needs and will be communicated to you during onboarding. All fees are non-refundable unless otherwise stated. We reserve the right to modify pricing with reasonable advance notice.
7. Disclaimer of Warranties
The Profita platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the platform's reliability, accuracy, or fitness for a particular purpose. Advertising performance results may vary and past performance does not guarantee future results.
8. Limitation of Liability
To the maximum extent permitted by law, Grova Technology (HK) Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of profits, data, or business opportunities.
9. Termination
We may suspend or terminate your access to the platform at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via the platform or email. Continued use of the platform after changes constitutes acceptance of the updated Terms.
